Kambwili Found Guilty, Sentenced To One Year With Hard Labour!
National Democratic Congress Party Chishimba Kambwili has been sentenced to one year imprisonment with hard labour for each of the two charges he has been found guilt on in the Lusaka Magistrate Court. The two sentences will run concurrently.
This is in a matter, Kambwili was charged with three counts of forgery, uttering a false document and having provided false information to a public officer. When the matter came up for judgement, Magistrate David Simusamba found Kambwili guilty on two charges while he has been aquited on one.
In the first count, Magistrate Simusamba stated that "Taking into account of all the information, I take it that the accused was behind the fictitious person Mwamba Chishimba and I therefore find the accused guilty on this charge."
And in the second count, "Although the accused claims that he had no contact with PW4, I believe that accused was the one that prepared form 71 which is a false document as it tells a lie about itself. This therefore follows that the accused did utter the document. I accordingly find the accused guilty on this charge."
"In the third count on giving false information, I accordingly acquit the accused on this charge."
And in Mitigation Musa Mwenye, State Counsel, pleaded with the Magistrate to exercise leniency on Kambwili as he is a family man. He stated that Kambwili is a diabetic patient and known to be a hypertensive patient
And in passing Judgment, Magistrate Simusamba jailed Kambwili for one year on each count further stating that the convict has the right to appeal. The sentence means Kambwili will only be jailed for a year as the two sentences will run concurrently.
